This Privacy Policy describes how Serve You Custom Prescription Management, Inc., d/b/a Serve You Rx ("Serve You Rx," "we," "us," or “our”) may collect information about you through your interactions with us on our websites and mobile applications (collectively, the "Services"). By using the Services, you agree to the terms of this Privacy Policy. If you have any questions or concerns about this Privacy Policy, or about the way your information is collected and used, please call us toll-free at 800-759-3203.

To the extent that information collected through the Services is subject to the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”) (e.g., identifiable patient or member information related to care or payment for care), the terms of the applicable HIPAA laws and regulations will apply to such information. If you have questions about whether this Policy applies to the information you have submitted, please do not hesitate to contact us using the contact information listed below.

This Privacy Policy does not apply to information that Serve You Rx collects about you on other Serve You Rx owned, operated, or sponsored websites that do not contain a link to this Privacy Policy.

Privacy laws and guidelines are part of a constantly changing environment. We may modify or update this Privacy Policy. The "Effective Date" at the top of this page indicates when this Privacy Policy was last revised. Any changes will become effective when we post the revised Privacy Policy on the Services. Your use of the Services following these changes means that you accept the revised Privacy Policy.

Who May Use the Services

The content of our website is intended for adults and adult caregivers and is not intended for children under 13 years of age. If you are under 13, do not use or provide any information on this Website. We do not knowingly collect personal information online from any person we know to be under the age of 13. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 13, please contact us at Compliance@ServeYouRx.com.

The online Services are designed for users from, and are controlled and operated by us from, the United States. By using the Services, you consent to the transfer of your information to the United States or storage of your information in the United States, which may have different data protection rules than those of your country.

The Personal Information We Collect

We want you to understand how personal information you provide to us is collected and used. Personal information means information that identifies you or is associated with you. Categories of personal information we may collect include:

  • Contact information, such as name, postal address, email address, and phone number.
  • Device and network information, such as IP address, cookies, and other online identifiers.
  • Internet activity and interactions, such as the webpages you visit and how you use the Services.
  • Non-precise geolocation data, such as the state you live in.

We may combine the information collected from you through the Services with information we receive from and about you from other online and offline sources and use the combined information in accordance with this Privacy Policy. Our goal is to offer you content, products, and services that are most likely to appeal to you.

Use and Disclosure of Personal Information

We may use your personal information to provide you with the Services and for the following purposes:

  • Services and Support. To provide and operate our Services, communicate with you about your use of the Services, provide you with information about our Services, including information about health care, health related services, resources and benefits that will help you manage your health; sending administrative information to you, such as changes to our terms, conditions, and policies; provide troubleshooting and technical support, respond to your inquiries, fulfill your requests, process your payments and claims, communicate with you about the Services, complete transactions, and provide quotes;
  • Customization and Personalization. To tailor content, we may send or display on the Services, including offering location customization and personalized help and instructions, and to otherwise personalize your experiences;
  • Marketing and Advertising. For marketing and advertising purposes. For example, to send you information about our Services, such as offers, promotions, newsletters and other marketing content, as well as any other information that you sign up to receive. We also may use certain information we collect to manage and improve our advertising campaigns so that we can better reach people with relevant content;
  • Analytics and Improvement. To better understand how users access and use the Services, and our other products and offerings, and for other research and analytical purposes, such as to evaluate and improve our Services and business operations, to develop services and features, and for internal quality control and training purposes;
  • Research and Surveys. To administer surveys and questionnaires, such as for market research or member satisfaction purposes;
  • Infrastructure. To maintain our facilities and infrastructure and undertake quality and safety assurance measures;
  • Authentication. To authenticate or confirm your identity;
  • Security and Protection of Rights. To protect the Services and our business operations; to protect our rights or those of our stakeholders; to prevent and detect fraud, unauthorized activities and access, and other misuse; conduct risk and security control and monitoring; where we believe necessary, to investigate, prevent or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety or legal rights of any person or third party, or violations of our Terms of Use as well as any supplemental terms that may apply;
  • Compliance and Legal Process. To comply with the law and our legal obligations, to respond to legal process and related to legal proceedings;
  • General Business and Operational Support. To consider and implement mergers, acquisitions, reorganizations, bankruptcies, and other business transactions such as financing, and related to the administration of our general business, accounting, auditing, compliance, recordkeeping, and legal functions; and
  • Deidentification. We may also aggregate or de-identify data by removing identifying details so it no longer identifies an individual.

To the extent we collect your Personal Information as described above, we may disclose Personal Information for the following purposes:

  • Operating the Services and Providing Related Support. To provide and operate our Services, communicate with you about your use of the Services, provide troubleshooting and technical support, respond to your inquiries, fulfill your requests, and for similar service and support purposes.
  • Business Transfers. If we are acquired by, merged with, or invested in by another company, or if any of our assets are or may be transferred to another company, whether as part of a bankruptcy or insolvency proceeding or otherwise, we may transfer the information we have collected from you to the other company. As part of the business transfer process, we may share certain of your Personal Information with lenders, auditors, and third-party advisors, including attorneys and consultants.
  • In Response to Legal Process. We may disclose your Personal Information to comply with the law, a judicial proceeding, court order, or other legal process, such as in response to a court order or a subpoena.
  • To Protect You, Ourselves, and Others. We disclose your Personal Information when we believe it is appropriate to do so to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety of any person, violations of our Terms of Use or this Notice, or as evidence in litigation in which we are involved.

We may disclose the Personal Information that we collect for the purposes described above with the following parties:

  • Vendors, Providers, and Business Partners. We may disclose Personal Information we collect to our service providers or agents who perform functions on our behalf. These may include, for example, IT service providers, help desk, payment processors, analytics providers, consultants, other service providers, auditors, and legal counsel.
  • Our Business Customers. Any Personal Information that we collect and process on behalf of a business client will be disclosed as directed by that business customer.
  • Government or Public Authorities. We may disclose Personal Information to a third party if (a) we believe that disclosure is reasonably necessary to comply with any applicable law, regulation, legal process, or governmental request, (b) to enforce our agreements, policies, and Terms of Use, (c) to protect the security or integrity of our Services, (d) to protect the property, rights, and safety of us, our users, or the public from harm or illegal activities, (e) to respond to an emergency which we believe in the good faith requires us to disclose information to assist in preventing the death or serious bodily injury of any person, or (f) to investigate and defend ourselves against any third-party claims or allegations.

The Services may contain links to, or otherwise make available, third-party websites, services, or other resources not operated by us or on our behalf ("Third Party Services"). These links are provided as convenience only and do not constitute an affiliation with, endorsement or sponsorship of the Third-Party Services. Any information you provide to such third parties is not subject to the terms of this Privacy Policy, and we are not responsible for the privacy or security of the information you provide to them or their handling of your information. We recommend that you review the privacy policy of any third party to whom you provide personal information online.

In addition, we are not responsible for the information collection, use, disclosure, or security policies and practices of other organizations, such as Apple, Google, Microsoft, RIM, or any other app developer, app provider, operating system provider, wireless service provider, or device manufacturer.

Security

We seek to use reasonable physical, technical, and administrative safeguards to protect personal information within our organization. Our website is scanned on a regular basis for security holes and known vulnerabilities in order to make your visit to our site as safe as possible.

Your personal information is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems, and we are required to keep the information confidential. In addition, all sensitive information you supply is encrypted via modern encryption tools.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Website, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. You agree to accept responsibility for all activities that occur under your password.

If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of your account with us has been compromised), please immediately contact us in accordance with the "Contact Information" section below.

Cookies and Other Technologies

Like many other websites and online services, we collect information about the Services' traffic and usage patterns using cookies, web server logs, web beacons and other, similar technologies. We use this information for various purposes, such as to ensure that the Services function properly, to facilitate navigation, to personalize your experience, to understand use of the Services, to diagnose problems, and to otherwise administer the Services.

Cookies are small computer files we transfer to your computer's hard drive. These small text files help us personalize content on our pages and provide programs.

Our use of cookies also allows us to collect and receive certain information about a website user, such as the type of web browser used by our customers. Reviewing our web server logs, and our customers' use of our site helps us to, among other purposes, statistically monitor how many people are using our site and for what purpose.

Pixel tags are a type of technology placed on a website or within the body of an email for the purpose of tracking certain activity, such as views of a website or when an email is open. Pixel tags are often used in combination with cookies. Clear GIFs are tiny graphics with a unique identifier, similar in function to cookies. In contrast to cookies, which are stored on your computer’s hard drive, clear GIFs are embedded invisibly on web pages.

If you wish to prevent cookies from tracking your activity on our Services or visits across multiple websites, you can set your browser to block certain cookies or notify you when a cookie is set. The Help portion of the toolbar on most browsers will tell you how to prevent your device from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether. Visitors to our Services who disable cookies will be able to browse the Services, but some features may not function.

Your IP address is a number that is automatically assigned to the computer that you are using by your Internet Service Provider. An IP address may be identified and logged automatically in our Web server log files whenever a user accesses the Services, along with the time of the visit and the page(s) that were visited. Collecting IP addresses is standard practice and is done automatically by many websites, applications and other services. We use IP addresses for purposes such as calculating usage levels of the Services, helping diagnose server problems, and administering the Services.

Google Analytics. We use Google Analytics to collect and process information about your use of the Services. Google sets Tracking Technologies on your device that will automatically send data to Google. Google uses this data to provide us with reports that we use to improve the Services’ and App’s structure and content and to learn more about our user base. This information may be stored on Google’s servers. Google may then use this information to provide us with reports about traffic to our Services and your visit to our Services (such as the domain from which you access the internet, the web address of the website from which you linked to our Services, the time and date of your visit to the web pages that you view and click-through). We will use this data to improve our Services structure and content.

reCAPTCHA. We may use and implement reCAPTCHA, a Google tool to help fight spam and misuse on our Site. As a result, certain personal information may be disclosed to Google for this purpose.

Text Messaging

Mobile information will not be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Fraudulent Sites, Spam & Phishing

Please be aware that there may be fraudulent websites that illegally use Serve You Rx logos, and other aspects of the Serve You Rx brand. Serve You Rx is in no way associated with any fraudulent websites. These sites may circulate their presence on the internet, via spam email, or through fraudulent phishing practices.

These sites have not been authorized by Serve You Rx to use our name. If you are in receipt of this type of spam email, to help protect your privacy you should avoid replying to it or forwarding it to other people. Communications from us will only come from ServeYouRx.com email addresses.

In addition to our official websites, Serve You Rx works with third parties that host websites and microsites that provide information and services to our customers. If you are concerned that a website or an email may be fraudulent, please contact us at Compliance@ServeYouRx.com with your concerns.

Your Choices and Access

You can request the removal or modification of the personal information you have provided to us by sending an email to Compliance@ServeYouRx.com. For your protection, we may only implement requests with respect to the personal information associated with the particular email address that you use to send us your request, and we may need to verify your identity and obtain information on the context in which you provided your personal information before implementing your request. We will try to accommodate your request as soon as reasonably practicable.

Please note that we may need to retain certain information for recordkeeping purposes and/or to complete any transactions that you began prior to requesting such change or deletion. There may also be residual information that will remain within our databases and other records, which will not be removed.

If you are a minor, you may remove or request removal of any content or information you post on our site. To request removal of content or information you have posted to our site, please email Compliance@ServeYouRx.com. Removal or requests for removal of content or information that has been posted to our website does not ensure complete or comprehensive removal.

We do not “sell” Personal Information under this definition. Some states provide a right to opt out of the automated processing of your Personal Information by us for decisions that produce legal or similarly significant effects concerning you, but we do not process Personal Information for such profiling. If any information in this section conflicts with the main body of this Policy above, the information in this Section controls for California residents, but only if they are applicable to Serve You Rx and your use of the Services. Not all state laws may be applicable. Capitalized terms used in this state-specific section but that are not defined in this Policy have the meanings set forth in the California Consumer Privacy Act of 2018 as amended by the California Privacy Rights Act of 2020 and its implementing regulations (collectively, the ​“CCPA”).

Collection, Sources, Purpose, Sharing and Retention of Your Personal Information

Categories of Personal Information We Collect. In the last twelve (12) months, we may have collected the following categories of Personal Information:

Identifiers consisting of real name, alias, postal address, unique personal identifier, online identifier, internet protocol address (“IP Address”), email address, or other similar identifiers.

Consumer information under Cal. Civ. Code 1798.80(e) consisting of: physical characteristics or description, telephone number, state identification number, health insurance number, insurance policy number, and any other medical information.

Protected Classifications consisting of: Age, citizenship, medical condition, physical or mental disability, sex (including gender), veteran or military status.

Commercial Information consisting of records of products or Services purchased, obtained, or considered.

Internet Activity consisting of browsing history, search history, and information regarding a consumer’s interaction with an internet website application, or advertisement.

Geolocation Data: approximate GPS geolocation and IP address depending in part on your device and account.

Employment Information: Professional or employment-related information.

Sensitive Personal Information: consumer’s account log-in, password, or credentials allowing access to an account.

Categories of sources from which Personal Information is collected. The categories of sources from which Personal Information is collected is described in the Personal Information We Collect section (The Personal Information We Collect).

Purposes for Collecting Personal Information. The purposes for collecting Personal Information are described above in the section titled “Use and Disclosure of Personal Information.”

Categories of Service Providers and Third Parties to Whom Personal Information is Disclosed for a Business Purpose. In the last 12 months we may have disclosed all of the categories of Personal Information described above under ​“The Personal Information We Collect.” The categories of third parties and/​or service providers with whom we disclosed Personal Information in the last 12 months are described under “Use and Disclosure of Personal Information.”

Categories of Third Parties Personal Information Sold or Shared. In the last 12 months we have not Sold or Shared Personal Information of any individual for compensation or cross-contextual behavioral advertising and we currently do not Sell or Share Personal Information.

We do not have any actual knowledge of selling or sharing Personal Information of any individual under the age of 16 for monetary compensation or for cross-context behavioral advertising.

Sensitive Personal Information. We have not used or disclosed Sensitive Personal Information for any reason other than the reasons for which it was provided to us. We do not use Sensitive Personal Information to infer characteristics about individuals.

Data Retention. We determine how long to retain Personal Information, which applies to all categories of Personal Information, based on our legal obligations, how long we need to retain your Personal Information for the purposes we collected it, and our internal data retention policies.

Your California Consumer Data Rights 

Subject to certain limitations such as (a) exceptions permitted by applicable law and (b) verification of your identity, if you are a California resident, you may exercise the following rights regarding your Personal Information:

Right to Request Access. You have the right to request access to, and receive a copy of, the specific pieces of Personal Information that we have collected in the last 12 months, and to have this delivered, either (a) by mail or (b) electronically in a portable format and, to the extent technically feasible, in a readily useable format.

Right to Request to Know. You have a right to request information about the Personal Information we have collected about you, including any of the following that occurred in the last 12 months:

  • the categories of Personal Information we collected from you,
  • the categories of sources from which the Personal Information was collected,
  • the business or commercial purpose for collecting, Selling or Sharing your Personal Information,
  • the categories of third parties with whom we disclosed, Sold or Shared your Personal Information,
  • the specific pieces of Personal Information we collected from you, and
  • a list of categories of Personal Information we Sold, Shared or disclosed for a Business Purpose.

Right to Request Deletion. You have the right to request that we delete the Personal Information we collected from you. We will comply with such requests, and direct our service providers to do the same, subject to certain exceptions permitted by applicable law.

Right to Opt-Out of the Sale or Sharing of Your Personal Information. You have the right to request that we do not Sell or Share any Personal Information. As noted above, we do not ​“Sell” or ​“Share” any Personal Information as defined by CCPA.

Right to Request Correction of Inaccurate Personal Information. You have the right to request that we correct inaccurate Personal Information that we maintain about you. We will make commercially reasonable efforts to make any such corrections as required by applicable law.

Right to Limit Use and Disclosure of Sensitive Personal Information. You have the right to limit our use and disclosure of your Sensitive Personal Information to only uses that are necessary to perform the Services Serve You Rx provides to you. We do not use or disclose Sensitive Personal Information for any purpose other than the purpose for which it was collected.

Right to Non-Discrimination. You have a right to not receive discriminatory treatment for exercising any of your rights under the CCPA. Should you wish to exercise any of your rights as detailed above, we will not discriminate against you by offering you different services based solely upon your exercise of the above rights.

CALIFORNIA’S ​“DO-NOT-TRACK” REQUIREMENT. WE CURRENTLY DO NOT HONOR ​“DO NOT TRACK” REQUESTS.

How to Exercise Your California Consumer Rights.

Submitting a Request. To exercise your California rights described in this Section, you may submit your request to us by contacting us at any of the following:

Verifiable Consumer Request. To verify your request, you must provide sufficient information to allow us to reasonably verify you are the person about whom we collected Personal Information, and you must describe your request with sufficient detail to allow us to properly understand, evaluate, and respond to your request. This information may vary depending on the Personal Information we already have. We will only use Personal Information we collect during the verification process for the purpose of verifying your identity. If you maintain an account with us, we may use that account to respond to your request and/​or verify your identity. If we are unable to verify your identity as required by applicable laws and regulations, we will decline to comply with your request, and let you know why.

Authorized Agents. You may only make a request to exercise your rights on behalf of yourself, or a parent or legal guardian may make a request on behalf of their child. You also have a right to submit requests to exercise your rights under the CCPA through an authorized agent. If an authorized agent contacts us to exercise the above rights, we will need to verify their identity as well as your identity. We will also require proof of your written authorization to the agent to be your agent and to make the specific request submitted, unless the agent is subject to a Power of Attorney under California probate laws. If the agent is a Power of Attorney under California probate laws, we may require evidence of that status.

When We Will Respond. We will confirm receipt of your request within 10 business days. We will try to respond to your request within 45 days. If we require additional time, we will inform you of the reason and extension period. Any disclosures we provide will only cover the 12-month period preceding our receipt of your request. We may charge a fee to process or respond to your request if it is excessive, repetitive, or manifestly unfounded.

Denial and Right to Appeal. We may deny your request if permitted by CCPA. If we deny your request, you will have the right to appeal within thirty (30) days of our sending the denial by responding directly to the communication denying your request or by emailing us at Compliance@​ServeYouRx.​com.
